Terms of Service

Welcome to SuperStudio. These Terms of Service (“Terms”) govern your access to and use of the SuperStudio platform, operated by Supermind AI (“Company,” “we,” “our,” or “us”). By subscribing to or using SuperStudio, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

These Terms apply to all users of SuperStudio, including fitness studios, gyms, wellness centers, sports facilities, and beauty establishments operating in the Philippines and other applicable jurisdictions.

1. Definitions

For purposes of these Terms:

  • “Platform” means the SuperStudio software-as-a-service application, including all features, tools, integrations, and related services.
  • “Subscriber” or “you” means the business entity or individual who has created an account and subscribed to a SuperStudio plan.
  • “Subscription Plan” means the selected tier (Starter, Pro, or Chain) and associated billing cycle.
  • “Member Data” means any information about your clients, members, or customers that you input into or generate through the Platform.
  • “Add-On Services” means the Done-For-You (DFY) Setup package and Website Package offered as optional enhancements.

2. Eligibility and Account Registration

To use SuperStudio, you must:

  • Be at least 18 years of age.
  • Be a legally registered business or authorized representative thereof.
  • Provide accurate, complete, and current information during registration.
  • Maintain the security of your account credentials and notify us immediately of any unauthorized access.

You are responsible for all activity that occurs under your account. Supermind AI reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Subscription Plans and Billing

3.1 Available Plans

SuperStudio offers the following subscription tiers:

  • Starter — ₱1,499/month: For solo studios and small fitness businesses getting started.
  • Pro — ₱2,999/month: For growing studios needing advanced automation and member management.
  • Chain — ₱5,499/month: For multi-location businesses requiring centralized management across branches.

3.2 Billing and Payment

  • Subscriptions are billed monthly or annually, as selected at checkout.
  • Payment is processed via PayPal. By subscribing, you authorize us to charge your selected payment method on a recurring basis.
  • Prices are listed in Philippine Pesos (PHP) and are inclusive of applicable fees unless otherwise stated.
  • Failed payments will trigger an account lock flow. You will be notified and given a grace period to update your payment details before access is suspended.

3.3 Add-On Services

  • Done-For-You (DFY) Setup: A one-time fee available at checkout. Work commences immediately upon purchase and is non-refundable.
  • Website Package: An optional add-on offered post-checkout. Non-refundable once design work has commenced.

3.4 Price Changes

We reserve the right to modify pricing at any time. Existing subscribers will be notified at least 30 days in advance before any price change takes effect on their account.

4. 30-Day Money-Back Guarantee

4.1 Our Commitment

Supermind AI offers a 30-day money-back guarantee on all new SuperStudio subscriptions. If you are not fully satisfied within the first 30 days of your subscription, you may request a full refund — no questions asked.

4.2 Eligibility

To be eligible for a refund under this guarantee:

  • Your refund request must be submitted within 30 calendar days of your first payment.
  • The guarantee applies to the first billing cycle only, for Starter, Pro, and Chain plans.
  • Only one refund is permitted per business entity.
  • For annual subscriptions, refunds will be prorated for unused months remaining after the refund date.

4.3 Exclusions

The following are not covered by the 30-day money-back guarantee:

  • Done-For-You (DFY) Setup fees — non-refundable as work begins immediately upon purchase.
  • Website Package add-on fees — non-refundable once design work has commenced.
  • Subscription renewals and payments made after the initial 30-day window.
  • Accounts suspended or terminated for violation of these Terms of Service.
  • Refund requests submitted after the 30-day window has lapsed.

4.4 How to Request a Refund

To initiate a refund:

  1. Email partners@super-studio.tech with the subject line “Refund Request” and your registered business name or account email address.
  2. Our team will verify your eligibility and confirm within 1 business day.
  3. Approved refunds will be processed within 5–7 business days to your original payment method via PayPal.
  4. Upon refund approval, your SuperStudio account and associated data will be deactivated. You may request a data export before closure.

5. Cancellation and Termination

5.1 Cancellation by Subscriber

You may cancel your subscription at any time through your account settings or by contacting partners@super-studio.tech. Cancellation will take effect at the end of your current billing cycle. No partial refunds are issued for mid-cycle cancellations, except as covered under Section 4.

5.2 Termination by Supermind AI

We reserve the right to suspend or terminate your account without prior notice if:

  • You breach any provision of these Terms.
  • Payment fails and is not resolved within the grace period.
  • Your use of the Platform causes harm to other users, third parties, or Supermind AI.
  • We are required to do so by applicable law or regulation.

Upon termination, your access to the Platform and your data will be deactivated. You may request a data export within 14 days of account closure.

6. Use of the Platform

6.1 Permitted Use

SuperStudio is licensed to you for lawful business use in operating your fitness or wellness studio. You may use the Platform to manage memberships, bookings, payments, staff scheduling, payroll, inventory, and member communications.

6.2 Prohibited Use

You may not:

  • Reverse-engineer, decompile, or attempt to extract the source code of the Platform.
  • Use the Platform to transmit spam, malware, or any content that violates applicable law.
  • Resell, sublicense, or otherwise transfer access to the Platform to any third party.
  • Use the Platform in any manner that could damage, disable, or impair its infrastructure.
  • Collect or harvest data from other users without their consent.

7. Data Privacy and Security

We collect and process personal data in accordance with applicable Philippine data privacy laws, including the Data Privacy Act of 2012 (Republic Act 10173).

You retain ownership of all Member Data you input into the Platform. By using SuperStudio, you grant Supermind AI a limited license to process this data solely to provide the service.

We implement commercially reasonable security measures to protect your data. However, no system is completely secure and we cannot guarantee absolute security. You are responsible for obtaining the appropriate consents from your members for the collection and use of their data through the Platform.

8. Intellectual Property

All intellectual property rights in the SuperStudio Platform, including its software, design, trademarks, logos, and content, are owned by or licensed to Supermind AI. Nothing in these Terms grants you ownership of any intellectual property. You retain all rights to your own business content, brand materials, and Member Data uploaded to the Platform.

9. Third-Party Integrations

SuperStudio integrates with third-party services including but not limited to:

  • PayPal — for subscription billing, recurring payments, and payment processing.
  • Viber — for automated member communication and reminders.

Your use of these integrations is subject to the respective terms and privacy policies of each third-party provider. Supermind AI is not responsible for the availability, accuracy, or conduct of third-party services.

10. Disclaimers and Limitation of Liability

10.1 Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

10.2 Limitation of Liability

To the fullest extent permitted by law, Supermind AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Platform, including but not limited to lost revenue, lost data, or business interruption. Our total liability to you for any claim shall not exceed the amount paid by you to Supermind AI in the three months preceding the claim.

11. Modifications to the Terms

We reserve the right to update or modify these Terms at any time. Subscribers will be notified via email at least 14 days before material changes take effect. Continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the appropriate courts in Metro Manila, Philippines.
